Wiibidate Terms of Service

These Terms of Service, together with the Privacy Policy, Refund Policy, Cookie and Tracking Notice, Content Reporting and Appeals Policy, and any purchase terms displayed at checkout, form a legally binding agreement between you and KELCORP LTD in relation to your access to and use of Wiibidate.

Summary of important terms

• Wiibidate is a freemium dating, social discovery, matching, messaging and content-sharing service operated by KELCORP LTD.

• The Service is primarily for adults. Users must be at least 18 unless Wiibidate has expressly made a local version available in a jurisdiction where younger users may lawfully use matchmaking services. Adult, explicit, paid adult, sexual, cash-out, and video-call features are always restricted to users who are legally permitted to access them and, in all cases, to users aged 18 or over where required by law or platform rules.

• Wiibidate does not guarantee matches, dates, compatibility, relationships, identity, age, safety, honesty, legality, or suitability of any user.

• Wiibidate does not conduct criminal background checks and does not guarantee that verification, email verification, AI-assisted checks, or moderation will detect all risks.

• You are responsible for your interactions with other users, including offline meetings.

• Premium subscriptions auto-renew unless cancelled by contacting kelcorp.shop@gmail.com, through any app-store mechanism that may apply, or through any cancellation tool we make available.

• Credits, gifts, boosts, stickers, and other digital items are subject to the Refund Policy and local consumer laws.

• We may moderate, restrict, suspend, delete, or report accounts and content, including through manual and AI-assisted review, where allowed or required by law.

• These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections that may apply in your country or region.

1. Definitions

 

In these Terms:

 

 

• “Account” means a registered Wiibidate account.

 

• “Adult Content” means nudity, explicit sexual content, sexually suggestive content, adult paid content, or any content that applicable law, payment providers, app stores, or platform rules restrict to adults.

 

• “Credits” means digital credits that may be purchased or otherwise obtained and used within the Service for eligible features, gifts, boosts, stickers, or similar items.

 

• “Premium” means the paid subscription tier made available by Wiibidate from time to time.

 

• “Service” means the Wiibidate website at https://wiibidate.fun, any future mobile application, web application, API, payment flow, messaging feature, video-call feature, profile feature, recommendation system, moderation system, or related service.

 

• “User Content” means any profile, photo, video, bio, message, gift, link, reaction, report, upload, communication, or other content submitted, posted, transmitted, displayed, sold, offered, shared, or otherwise made available through the Service.

 

• “we”, “us”, “our”, “Kelcorp” means KELCORP LTD, trading as Wiibidate.

 

• “you” means the individual or entity accessing or using the Service.

 

2. Operator and contact details

 

The Service is operated by KELCORP LTD, a company incorporated in England and Wales under company number 13756442, with registered office at 3 Newland Avenue, Maltby, Rotherham, S66 8AJ, England. For service, support, legal notices, content reports, complaints, appeals, cancellation requests, data-protection requests, law-enforcement queries, and general correspondence, contact kelcorp.shop@gmail.com.

 

We may require you to verify your identity, account ownership, authority, or relevant facts before acting on a request.

3. Acceptance of these Terms

 

By registering for, accessing, browsing, purchasing from, uploading to, communicating through, or otherwise using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

 

If you use the Service on behalf of another person or organisation, you represent that you have authority to bind that person or organisation.

4. Eligibility, age and local law

 

 

1. General rule. The Service is designed for users aged 18 or over. You must not use the Service if you are under 18 unless all of the following apply: the law of your location permits you to use matchmaking, dating, or social discovery services at your age; Wiibidate has not restricted the relevant feature to adults; and your use does not expose you or others to adult, explicit, commercial adult, or age-restricted content or interactions.

 

1. Adult features. Adult Content, paid Adult Content, explicit messaging, sexual video interaction, cash-out, creator monetisation, and any other age-restricted feature may only be accessed by users who are legally permitted to access that feature and, where required by law or platform rules, by users aged 18 or over.

 

1. Age of consent and sexual conduct. Adults must never engage in romantic, sexual, explicit, grooming, exploitative, coercive, or age-inappropriate conduct with any person below the applicable age of consent or legal age in the place where either person is located, or where the interaction occurs or is received.

 

1. Local compliance. You are responsible for complying with the laws of your location and any location where your content, communications, payments, gifts, or interactions are accessed or received.

 

1. Restricted access. We may restrict, suspend, block, or terminate access where we believe use of the Service may be unlawful, unsafe, sanctioned, age-inappropriate, contrary to platform rules, contrary to payment-processor rules, or otherwise high risk.

 

1. False age. If you provide a false age or date of birth, we may delete your Account, block identifiers associated with you, withhold access to age-restricted features, notify relevant authorities, and retain evidence where legally permitted.

 

5. Account registration and security

 

 

1. You may register using email and password. Email verification is required before full access is granted.

 

1. You must provide accurate, current, and complete information, including date of birth, and must keep your information updated.

 

1. Real names are recommended but not mandatory unless required for verification, payment, cash-out, law-enforcement, tax, anti-fraud, anti-money-laundering, safety, or legal purposes.

 

1. You may use a nickname or display name, provided it is not misleading, unlawful, abusive, impersonating, infringing, or unsafe.

 

1. You may not maintain more than one Account without our prior written permission.

 

1. You may not create a new Account to evade suspension, deletion, debt, refund abuse, moderation action, fraud controls, payment-provider restrictions, app-store restrictions, sanctions, or legal process. A previously banned user may request permission to return after five years, but we may refuse, especially where law, safety, prior conduct, or risk assessment requires refusal.

 

1. You are responsible for your login credentials and for all activity under your Account. If we permit credential sharing or account transfer in a particular case, you remain responsible for all activity, harm, charges, breaches, reports, and legal consequences arising from that Account unless we expressly agree otherwise in writing.

 

1. We may refuse registration or continued access at our discretion where lawful.

 

6. Profile information and matching

 

Wiibidate may allow you to create a profile, upload photos and videos, publish a public bio, swipe, like, friend, match, message, video call, send gifts, and use algorithmic matching. Wiibidate does not allow manual user search unless and until we introduce that feature.

 

Free users may mainly see people close to them. Premium users may access additional location-based and country-based matching features. Matching, ranking, profile visibility, random-user presentation, premium bars, boost placement, notifications, and recommendation results may be influenced by account status, location, activity, reported conduct, safety signals, preferences, popularity, fraud controls, moderation status, purchased features, and algorithmic matching.

 

We do not guarantee that any match, like, friend, recommendation, notification, boost, premium placement, country filter, or visibility feature will result in a conversation, date, relationship, payment, gift, profile view, or any particular outcome.

7. Premium subscriptions, Credits and paid features

 

7.1 Premium

 

Premium may be offered on weekly, monthly, yearly, or other billing intervals. Premium features may include, without limitation:

 

 

• additional stickers in chat;

 

• placement in a premium bar;

 

• like notifications;

 

• discounts when using “boost me”;

 

• higher placement in find-matches features;

 

• higher display in random-user features;

 

• country-based potential-match discovery; and

 

• other features displayed at purchase or in the Service.

 

 

Premium subscriptions renew automatically unless cancelled. You may cancel by emailing kelcorp.shop@gmail.com, by using any account cancellation control we make available, or through the relevant mobile app store if the subscription was purchased through a future app-store system. Cancellation generally stops future renewals; unless required by law or stated at checkout, Premium access may end at cancellation and may not continue through the remaining billing period.

7.2 Credits

 

Credits may be purchased in bundles, earned, transferred through gifts where enabled, or used for eligible Service features, including boosts, gifts, stickers, or similar digital items. Credits are not legal tender, deposit accounts, stored-value accounts, e-money, financial products, securities, cryptocurrency, or cash equivalents. Credits have no cash value except where we expressly allow eligible cash-out or where required by law.

 

Credits do not expire unless stated at purchase or required by law, but they may be deleted when your Account is deleted, when Credits are obtained fraudulently, when a payment is reversed, or when law, safety, payment-provider rules, app-store rules, tax rules, or anti-money-laundering rules require restriction.

7.3 Gifts, monetisation and cash-out

 

Where enabled, users may send gifts or transfer value through gifts, and eligible users may cash out gift value or other monetisation balances. Cash-out is subject to eligibility, identity checks, age checks, fraud checks, anti-money-laundering checks, sanctions checks, tax reporting, minimum thresholds, fees, payment-provider rules, app-store rules, local law, and our approval. We may delay, refuse, reverse, withhold, offset, or report a cash-out where we reasonably suspect illegality, fraud, abuse, exploitation, chargebacks, underage use, sanctions risk, tax risk, policy breach, payment risk, or unsafe conduct.

 

You are responsible for taxes, duties, declarations, local licences, and legal compliance connected with gifts, creator earnings, tips, cash-outs, and other monetisation.

7.4 Payment methods and currency

 

Prices are displayed in United States dollars unless we display another currency. Taxes, VAT, sales tax, duties, payment fees, foreign exchange charges, crypto network fees, bank fees, and app-store charges may apply and may be shown separately unless local law requires tax-inclusive pricing.

 

Payments may be processed by Stripe, Bitcoin or other cryptocurrency payment systems, app stores, or other providers. Payment providers may have their own terms, identity checks, chargeback rules, fees, restrictions, and privacy practices.

 

Cryptocurrency payments carry volatility, network, wallet, exchange-rate, and transaction-finality risks. Where a cryptocurrency refund is legally required or voluntarily approved, we may refund the USD-equivalent purchase price, the original crypto amount, or another lawful amount using a method we reasonably choose, subject to law and payment-provider rules.

8. Consumer cancellation rights and refunds

 

Refunds and cancellation rights are governed by the Refund Policy and by any mandatory consumer rights that apply in your country. For UK and EU consumers, distance-selling and digital-content rules may provide a 14-day cancellation period for certain purchases. Where lawful, we may ask you to expressly consent to immediate supply of digital services or digital content and acknowledge that cancellation rights may be affected once performance begins.

 

If you are banned, suspended, restricted, or deleted for breach of these Terms, refunds are not usually provided, except where required by law or where the Refund Policy expressly provides otherwise. You may request a refund for eligible purchases made in the previous 14 days by emailing kelcorp.shop@gmail.com.

9. User Content

 

 

1. You are solely responsible for your User Content and for the consequences of posting, sending, monetising, displaying, linking, selling, or sharing it.

 

1. You must own, control, or have all necessary rights and permissions for your User Content.

 

1. You must not upload, send, sell, request, display, link to, or promote content that is unlawful, non-consensual, exploitative, abusive, infringing, fraudulent, malicious, privacy-invasive, defamatory, harassing, or otherwise prohibited by these Terms.

 

1. Photos, videos, GIFs, bios, messages, and approved social-media links may be supported. Irrelevant, unsafe, illegal, deceptive, malicious, or unapproved links are prohibited.

 

1. You may not promote a business competing with Wiibidate or other dating, matchmaking, social discovery, adult-content, or relationship platforms without our prior written permission.

 

1. You must not upload another person’s images, likeness, intimate content, private information, or copyrighted material without all necessary consent and rights.

 

1. We may require proof of consent, age, rights ownership, identity, or legality before allowing or continuing to host content.

 

10. Adult Content and sexual content

 

Wiibidate may permit certain adult, suggestive, nude, sexual, or explicit content where it is lawful, consensual, appropriately age-restricted, behind an applicable paywall where required by our rules, or shared in private messages between legally consenting users. This permission is not absolute. We may restrict, remove, age-gate, demonetise, disable, report, or block Adult Content where required by law, platform rules, payment-provider rules, app-store rules, safety concerns, regional restrictions, age-assurance duties, or our risk assessment.

 

You must not send unsolicited sexual content. You must not send, request, buy, sell, threaten, coerce, extort, blackmail, impersonate, dox, or distribute intimate content without consent. Non-consensual intimate imagery, revenge pornography, sexual extortion, sexual exploitation, grooming, child sexual exploitation or abuse, and content involving minors are strictly prohibited and may be reported to authorities.

 

Sex work, escorting, sugar dating, paid companionship, adult monetisation, or transactional relationships may be restricted or prohibited in some jurisdictions and by some payment providers or app stores. You are responsible for local-law compliance. We may restrict or remove related content or accounts at any time where we believe doing so is legally, operationally, or commercially necessary.

11. Prohibited conduct

 

You must not, and must not attempt to, assist, encourage, or enable any of the following:

 

 

• illegal activity;

 

• child sexual exploitation or abuse, grooming, age-inappropriate sexual interaction, or sexualised content involving minors;

 

• human trafficking, coercion, exploitation, forced sexual activity, or modern slavery;

 

• non-consensual intimate imagery, revenge pornography, blackmail, sexual extortion, or threats;

 

• harassment, stalking, bullying, intimidation, threats, abuse, or targeted attacks;

 

• catfishing, impersonation, fake profiles, misleading identities, or use of another person’s photos without permission;

 

• scams, romance fraud, fraudulent payments, chargeback abuse, fake gifts, crypto fraud, phishing, or deception;

 

• malware, hacking, scraping, credential theft, bypassing security, reverse engineering, or interfering with the Service;

 

• spam, mass messaging, manipulation of rankings, fake engagement, or abusive automation;

 

• unauthorised collection, publication, sale, sharing, or misuse of other users’ data;

 

• copyright, trademark, publicity-right, privacy-right, or confidentiality infringements;

 

• sanctions violations, export-control violations, or dealings with sanctioned persons or regions where prohibited;

 

• off-platform conduct that harms users, Wiibidate, safety, trust, or the integrity of the Service.

 

 

We may also prohibit or restrict content or conduct not specifically listed where we reasonably believe it creates legal, safety, reputational, operational, payment, app-store, regulatory, or user-protection risk.

12. Safety and offline interactions

 

Wiibidate is a platform for online introduction, interaction, and content exchange. We are not responsible for the conduct, statements, identity, intentions, legality, background, health, financial condition, relationship status, criminal record, or suitability of users. We do not conduct criminal background checks, sex-offender checks, sanctions checks, or identity checks on all users.

 

Use caution. Do not rely solely on profile information, verification status, matching results, email verification, payment status, or Premium status. Consider meeting first in public places, telling someone where you are going, arranging your own transport, protecting your personal information, and using local emergency services if you are in immediate danger.

 

Wiibidate may provide emergency support if requested and if reasonably available, but Wiibidate is not an emergency service. If you face immediate danger, contact local police, ambulance, fire, crisis, or emergency services first.

13. Verification, AI-assisted checks and moderation

 

Wiibidate uses email verification and may use random or risk-based AI-assisted verification checks, manual review, user reports, behavioural signals, IP/device information, payment information, profile data, content data, and other safety signals to detect suspected age issues, fraud, scams, abusive conduct, fake profiles, or policy breaches. Verification may include requests for evidence, documents, selfies, confirmations, or other checks where lawful and proportionate.

 

Verification means only that a user completed a relevant check at a particular time. It is not a guarantee of identity, age, honesty, safety, criminal history, suitability, consent, relationship status, or future conduct.

14. Messaging, video calls and communications

 

Users may communicate through private messages, image and GIF sharing, gifts, read receipts, video calls, and other features we make available. Voice notes, livestreams, forums, and group chats are not currently provided unless later introduced.

 

We do not record video calls unless we clearly state otherwise, obtain required consent, or are required or permitted by law. Other users may attempt to record or share communications. You must not record, publish, distribute, threaten, or monetise another user’s private communications or intimate content without lawful consent.

 

Messages may be retained after unmatching, blocking, cancellation, suspension, or account deletion where legally permitted and reasonably necessary for safety, moderation, law enforcement, legal defence, fraud prevention, backups, or compliance. Individual message deletion is not currently supported unless required by law or introduced later.

15. Blocking, reports, complaints and appeals

 

Users may block, report, unmatch, and appeal moderation decisions using available tools or by emailing kelcorp.shop@gmail.com. We aim to respond to complaints within at least two weeks where reasonably possible, but urgent safety, child-safety, law-enforcement, payment, or legal issues may be handled differently.

 

We will usually provide notice before or at the time of content removal, account restriction, suspension, or deletion. However, where prior notice would create legal, safety, security, evidence-preservation, child-protection, fraud, enforcement, or operational risk, we may act first and provide notice as soon as reasonably practicable and legally permitted.

 

Users may appeal enforcement decisions. We may refuse repeated, abusive, fraudulent, bad-faith, unsafe, or legally restricted appeals.

16. Content moderation and enforcement

 

Moderation is carried out by KELCORP LTD using manual and AI-assisted methods. We may review public content, private messages, reports, metadata, payment signals, behavioural signals, verification signals, and other information where permitted by law and described in the Privacy Policy.

 

Depending on the issue, we may warn, age-restrict, reduce visibility, remove content, disable features, suspend, delete, block, report, preserve evidence, ban, restrict payments, withhold cash-outs, reverse Credits, remove Premium benefits, remove content from marketing, block devices or IP addresses, or take legal action. We may permanently ban repeat offenders.

 

Fake profiles, suspected scammers, romance fraud, abusive users, accounts involving minors in sexual contexts, and serious breaches may result in account deletion and blocking. We may cooperate with law enforcement, regulators, payment providers, hosting providers, app stores, and safety organisations.

17. Notice-and-action, copyright and illegal content

 

If you believe content on Wiibidate is illegal, infringes copyright, violates rights, includes non-consensual intimate imagery, involves minors, constitutes fraud, or otherwise breaches these Terms, contact kelcorp.shop@gmail.com with enough information to identify the content, your legal concern, your contact details, and a statement that your notice is accurate and made in good faith.

 

For copyright complaints, provide: identification of the copyrighted work; identification of the allegedly infringing material; your contact details; a statement of good-faith belief; a statement that the information is accurate; and confirmation that you are the rights owner or authorised to act for the owner. US DMCA-style notices and counter-notices may be processed where applicable.

 

Non-users may submit illegal-content notices. General service complaints, account appeals, and contractual requests are normally available to users only unless law requires otherwise.

18. Licence you grant to Wiibidate

 

When you submit User Content, you grant KELCORP LTD a worldwide, non-exclusive, transferable, sublicensable, royalty-free, fully paid, irrevocable to the fullest extent permitted by law, perpetual to the fullest extent permitted by law, licence to host, store, copy, reproduce, adapt, modify, translate, reformat, moderate, analyse, scan, classify, publish, display, distribute, transmit, promote, advertise, market, create derivative works from, commercialise, monetise, use in recommendations, use in safety systems, use in AI systems, use to train, test, develop, improve, and operate AI and machine-learning models, and otherwise use your User Content in connection with the Service, Wiibidate, KELCORP LTD, our business, safety, legal compliance, advertising, marketing, and product development.

 

This licence includes permission to use your profile, photos, videos, name, username, likeness, bio, content, and interactions in marketing materials, advertisements, product demonstrations, screenshots, social media, promotional pages, and similar materials. Where applicable law requires separate consent, compensation, opt-in, or withdrawal rights, this licence applies only to the maximum extent permitted by that law and by the consents you have provided.

 

When you delete content or your Account, this licence ends for future public display where required by law, except that we may continue using, retaining, disclosing, processing, or preserving content where it has been shared with others, used in marketing before deletion, incorporated into backups, retained for safety, fraud, moderation, evidence, law-enforcement, legal defence, accounting, tax, audit, AI model integrity, or compliance purposes, or where continued use is otherwise legally permitted.

19. Our intellectual property

 

Wiibidate, https://wiibidate.fun, the website, future apps, software, designs, databases, logos, icons, trade dress, source code, algorithms, matching systems, moderation systems, recommendations, graphics, text, business methods, documentation, and platform content are owned by or licensed to KELCORP LTD. No rights are granted except as expressly stated in these Terms.

 

You must not copy, scrape, crawl, index, mirror, frame, reproduce, sell, resell, reverse engineer, decompile, data-mine, train competing systems from, build competing datasets from, or otherwise exploit the Service or user data without our prior written consent. Screenshots, republication, quoting, or external sharing of another user’s profile, messages, photos, videos, or content may require that user’s consent and our prior written consent, and may be subject to a legally reasonable licence fee where we permit it.

20. Third-party services

 

The Service may integrate with or link to third-party services, including social-media links, Google Maps or location APIs, Stripe, Bitcoin or cryptocurrency processors, app stores, Amazon S3, Hostinger, advertising networks, affiliate programmes, CAPTCHA providers, email providers, cloud services, and other providers. We are not responsible for third-party services, content, security, availability, pricing, policies, decisions, outages, chargebacks, or data practices.

21. Data protection and privacy

 

Your use of the Service is subject to the Privacy Policy and Cookie and Tracking Notice. You acknowledge that Wiibidate may process sensitive and special-category data, including location, relationship preferences, sexual-orientation-related preferences, health-related information, religion, ethnicity, messages, photos, videos, and Adult Content, where lawful and subject to consent or another lawful basis as applicable.

 

You must not submit another person’s personal data unless you have a lawful basis and all required consents to do so.

22. Regional terms

 

22.1 United Kingdom

 

UK consumer law, data-protection law, e-commerce rules, online-safety rules, age-assurance duties, payment rules, and other mandatory laws may apply. Nothing in these Terms excludes or limits rights that cannot lawfully be excluded or limited.

 

22.2 European Union and European Economic Area

 

Where the EU Digital Services Act, GDPR, ePrivacy rules, consumer law, platform-to-business rules, or other EU/EEA laws apply, these Terms apply subject to those mandatory rules. EU/EEA users may have rights relating to illegal-content notices, statements of reasons, internal complaint handling, out-of-court dispute settlement, advertising transparency, recommender-system information, minors’ protection, privacy, and consumer remedies.

 

22.3 United States

 

US users agree to the arbitration, class-action waiver, and regional privacy provisions in these Terms, except where prohibited by law. California residents may have additional privacy rights described in the Privacy Policy.

 

22.4 Canada, Australia, New Zealand and other regions

 

Mandatory consumer, privacy, unfair-contract, online-safety, age, and trading laws of your region may apply. Nothing in these Terms limits rights, remedies, guarantees, or protections that cannot legally be excluded.

 

22.5 Africa and worldwide availability

 

Wiibidate is intended to be available worldwide, including in African countries, subject to local law, sanctions, payment availability, safety, age, moderation, hosting, and operational restrictions. You are responsible for ensuring that use of the Service, dating features, Adult Content, payments, gifts, cash-outs, and communications are lawful where you are located and where the recipient is located.

23. Disclaimers

 

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis.

 

We do not warrant that the Service will be uninterrupted, secure, error-free, available in every region, compatible with every device, free from harmful code, free from fake users, free from illegal content, free from unsafe users, or that matching, swiping, messaging, Premium, Credits, gifts, boosts, recommendations, verification, or moderation will meet your expectations.

 

We do not warrant user identity, age, intent, honesty, background, relationship status, health, suitability, criminal history, financial condition, location, sexuality, gender, religion, ethnicity, or compatibility. You use the Service and interact with users at your own risk.

24. Limitation of liability

 

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, statutory consumer rights that cannot be excluded, data-protection liability that cannot be excluded, or any other liability that cannot legally be excluded or limited.

 

Subject to the previous paragraph, to the maximum extent permitted by law, KELCORP LTD and its officers, directors, employees, contractors, agents, shareholders, affiliates, licensors, processors, and suppliers shall not be liable for indirect, consequential, special, punitive, exemplary, incidental, loss-of-profit, loss-of-revenue, loss-of-data, loss-of-goodwill, emotional distress, failed relationship, failed date, scam, offline harm, user conduct, payment-provider, app-store, hosting-provider, or third-party-service losses.

 

Subject to mandatory law, our aggregate liability to you arising out of or relating to the Service shall be limited to the greater of: (a) the amount you paid to Wiibidate in the 12 months before the event giving rise to the claim; or (b) GBP £100.

25. Indemnity

 

To the maximum extent permitted by law, you shall indemnify and hold harmless KELCORP LTD and its officers, directors, employees, contractors, agents, affiliates, processors, suppliers, and licensors from and against claims, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from your User Content, breach of these Terms, misuse of the Service, violation of law, infringement of rights, unsafe conduct, payments, gifts, cash-outs, tax obligations, disputes with users, or off-platform conduct.

26. Account deletion, suspension and termination

 

You may request Account deletion by emailing kelcorp.shop@gmail.com or using any available account-setting tool. We may require verification before deletion. Account deletion is intended to fully delete your Account from active user access, subject to lawful retention for safety, legal, fraud, tax, accounting, payment, backups, reporting, law-enforcement, audit, moderation, AI integrity, or legal-defence purposes.

 

We may terminate, suspend, restrict, or delete your Account where permitted by law. Serious breaches may result in immediate action, followed by notice where legally permitted and reasonably practicable. Unused Credits may be deleted when your Account is deleted, subject to mandatory refund rights.

 

Provisions intended to survive termination shall survive, including provisions relating to User Content, licences, payments, refunds, Credits, cash-outs, intellectual property, disclaimers, limitations of liability, indemnity, disputes, governing law, evidence retention, investigations, and compliance.

27. Changes to the Service and Terms

 

We may change, suspend, discontinue, rebrand, transfer, sell, merge, restructure, limit, or replace all or part of the Service. We may update these Terms. For material changes, we aim to provide at least one month’s notice by email and/or website notice unless shorter notice is required for legal, safety, operational, regulatory, payment, app-store, security, or emergency reasons.

 

Continued use after changes take effect constitutes acceptance, unless mandatory law requires another process.

28. Governing law and jurisdiction

 

These Terms and any non-contractual obligations arising from them are governed by the laws of England and Wales. Subject to mandatory consumer rights, the courts of England and Wales shall have jurisdiction, and claims may be brought in the County Court hearing centre covering Rotherham or another competent court of England and Wales.

 

If you are a consumer outside England and Wales, you may have mandatory rights to bring claims in your local courts or rely on the mandatory law of your country of residence.

29. Informal resolution, mediation, arbitration and class waiver

 

Before starting formal proceedings, you agree to contact kelcorp.shop@gmail.com and attempt in good faith to resolve the dispute informally for 30 days, except for urgent injunctive relief, child-safety matters, fraud, abuse, chargebacks, IP enforcement, or where prohibited by law.

 

Where lawful and applicable to non-UK users, disputes may be referred to mediation or binding individual arbitration under rules we identify at the time of dispute, subject to mandatory local law. US users agree, where lawful, to resolve disputes individually and not as a claimant or class member in any purported class, collective, consolidated, or representative proceeding. Small-claims proceedings and claims that cannot lawfully be arbitrated are excluded.

31. General terms

 

If any provision is invalid or unenforceable, the remaining provisions continue in force. We may assign or transfer these Terms or the Service. You may not assign your rights without our prior written consent except where law requires otherwise. No failure to enforce a term is a waiver. Headings are for convenience only. These Terms, together with linked policies and checkout terms, form the entire agreement between you and us regarding the Service.
